What is a Trademark?
Trademarks are symbols that are used to identify the item, product or service uniquely from other companies. Trademarks can be any image, graphics, design, expressions or signs. They uniquely identify the particular company from other companies.
Trademarks are to be renewed every 10 years of its registration. If the trademark holder does not renew his trademark in 10 years then still he has a chance of restoration which means renewal but with a fine.
How to renew a Trademark:
The trademark registrars will notify you at the time period of expiry. At the renewal time you can do two things:
- Renew the trademark as it is
- Renew the trademark with changes and alterations
You have to fill a form named: TM-R.
Cost of Renewal
If done physically the filing for the renewal costs 10,000 rupees
If done online via e-filing it costs 9,000 rupees
The following things are required for the renewal of trademark
- A copy of the registration certificate
- Copy of form TM-A
- ID and address proof
- Power of attorney
